Hiring a Digital Marketing Agency in the UK: The 2026 Buyer's Guide

How UK businesses should choose a digital marketing agency in 2026: UK GDPR and PECR, the ASA's CAP Code, Companies House checks, local SEO by postcode, and the questions worth asking.

UK businesses have a particular problem when they go looking for a digital marketing agency: the market is dense, the jargon is thick, and the regulators are more active than most agencies let on. The Advertising Standards Authority publishes rulings every Wednesday. The Information Commissioner's Office fines companies for email campaigns. Neither cares that "the agency did it".

The three rulebooks your agency must know

UK GDPR and the Data Protection Act 2018. Any tracking pixel, CRM integration, lead form or lookalike audience is personal-data processing. You need a lawful basis, a privacy notice that actually describes what happens, and records of it. The agency does not carry the liability; you do. Ask a prospective agency how they document lawful basis for retargeting and what their consent banner looks like in practice.

PECR. The Privacy and Electronic Communications Regulations govern email, SMS and cookies. Cookies that are not strictly necessary require consent before they are set, which is why so many UK sites run a proper consent-management platform rather than a decorative banner. Marketing email to individuals needs consent or the "soft opt-in" from an existing customer relationship. Bought lists are a fast route to an ICO enforcement notice.

The CAP Code. The ASA's non-broadcast code covers every claim in your ads, your website and your influencer posts: "best", "cheapest", "guaranteed", comparative claims, pricing claims, and disclosure of paid partnerships with "#ad". Rulings are public and searchable, and a ruling against your brand is a headline your competitors will happily share. A serious agency reviews creative against the CAP Code before it goes live.

Due diligence that takes ten minutes

  • Companies House. Look up the agency. Check the incorporation date against the "15 years of experience" claim, check the filed accounts are not overdue, and check the directors. It is free and it takes two minutes.
  • The ASA rulings database. Search the agency's clients. If their previous work has been ruled against, you want to know why.
  • Google partner status and Meta partner status are verifiable through the platforms, not through a badge on a website.
  • Reviews. Trustpilot and Google reviews are useful; Clutch profiles are curated by the agency. Read the three-star reviews, which tend to be the honest ones.

Local search in the UK is a postcode game

"Near me" searches in the UK resolve to very small areas: a borough in London, a district in Manchester, a town in the Home Counties. If you serve customers in person, the agency's local SEO plan should name the areas you cover and how each one will be represented: a Google Business Profile with the right categories and service areas, location pages for the places that matter to revenue (not one for every village), consistent name-address-phone data across Yell, Checkatrade, Thomson Local and industry directories, and a way of generating genuine reviews.

For national and B2B businesses the emphasis changes: category and comparison content that answers what UK buyers search for, digital PR that earns links from UK publications, and LinkedIn for professional-services and B2B audiences, which remains unusually strong in the UK.

Questions to ask before you sign

  1. Who owns the Google Ads, GA4, Google Business Profile and Meta accounts? You should. The agency is a user.
  2. Is ad spend billed directly by the platform to us? It should be. Fees and media should never be blended on one invoice.
  3. Show me a UK client in my sector and let me speak to them.
  4. How will you report? Monthly, tied to enquiries and revenue, with the platform data available to us directly, not a PDF of screenshots.
  5. What is the notice period? Thirty days after an initial period is reasonable. Twelve-month auto-renewals are not.
  6. Who does the work? Ask for names and locations. Subcontracting is fine if it is disclosed and a senior person owns the account.

UK agency or international team?

A London agency gives you in-person meetings and London overheads. Agencies in Manchester, Leeds, Birmingham or Glasgow are often as strong at lower cost. An international team, including ours, can work well for UK clients on three conditions: account management in UK business hours, creative written in British English by people who know the difference between a high street and a main street, and demonstrable UK GDPR, PECR and CAP Code practice. Ask for evidence of all three. If an international agency cannot show you a UK consent implementation and a UK client reference, they are learning on your account.

A simple way to decide

Brief three agencies identically and ask each for a 90-day plan rather than a credentials deck. The plan will tell you whether they looked at your Search Console, noticed your site sets cookies before consent, and know which competitor is bidding on your brand. Choose the plan you understood. If it is ours, book a call; if not, you have still hired well.
