Australia is a compact digital market with a few unusual features: two platforms (Google and Meta) take the overwhelming majority of ad spend, the population is concentrated in five metros, the financial year ends in June, and the regulators (the OAIC and the ACCC) have grown noticeably more assertive. Marketing that works in the United States or the UK often needs adjusting before it works in Sydney, Melbourne, Brisbane, Perth or Adelaide. This guide covers what changes.
TML Agency serves Australian clients from Canada and India, with account management during AEST mornings. We will be candid below about where that fits and where a local agency is the better call.
The compliance basics
The Privacy Act. The Australian Privacy Principles govern how businesses collect, use and disclose personal information, and reforms since 2024 have sharpened penalties and expanded the OAIC's powers. Marketing relevance: your privacy policy must describe what your pixels and CRM actually do, direct marketing needs a clear opt-out, and sensitive information needs consent. Ask an agency how they document this for the campaigns they run.
The Spam Act 2003. Commercial email and SMS need consent (express or inferred from an existing relationship), accurate sender identification and a functional unsubscribe. The ACMA enforces it, and it has fined household-name brands for unsubscribe failures. Any agency proposing email or SMS should show you their consent and unsubscribe handling before launch.
Australian Consumer Law. Misleading or deceptive conduct is the ACCC's favourite section, and it covers advertising claims, "was/now" pricing, comparison claims, fake reviews and undisclosed influencer relationships. Influencer disclosure is also covered by AANA codes. A serious agency reviews creative against the ACL before it runs.

Where Australians actually search and click
Google's share of search in Australia is among the highest in the world, and Meta (Facebook and Instagram) dominates social advertising, with TikTok growing fast for under-35s and LinkedIn strong for B2B. For most Australian businesses that means the plan is Google first, Meta second, and everything else as a considered add-on.
Local search is suburb-level. "Plumber Parramatta" and "plumber North Sydney" are different auctions with different customers. Local SEO should name the suburbs you serve, build a Google Business Profile with the right service areas, keep name-address-phone data consistent across Yellow Pages, hipages, TrueLocal and industry directories, and run a review programme, because Australians read reviews before they call.
The Australian calendar
Two seasons shape Australian marketing more than anywhere else we work. The end of financial year on 30 June drives B2B purchasing, equipment sales, software renewals and a flood of "EOFY" campaigns; budgets for these need to be live by May. Christmas falls in summer, so the November-to-January period combines retail peak with holidays, travel and outdoor categories, and the January quiet spell many Northern Hemisphere brands expect does not exist for hospitality and tourism. Add Boxing Day, Black Friday (now firmly established), Mother's Day in May and Father's Day in September, and the year has its own shape. A good plan is built around it rather than copied from a US template.
Industries with their own rules
Financial services advertising sits under ASIC's guidance and the design-and-distribution obligations; health and therapeutic goods under the TGA's advertising code; alcohol under ABAC; real estate under state-based agent regulation and underquoting laws. If you are in one of these sectors, ask the agency to show you a campaign they have run in it. Generic paid-media skills are not enough.

Choosing an agency
- Accounts in your name. Google Ads, GA4, Google Business Profile and Meta Business Manager belong to you; the agency is a user.
- Media billed by the platform to you. Agency fees are invoiced separately, so there is no hidden margin on spend.
- Australian references in your sector. Case studies are marketing; a phone call with a client is evidence.
- Hours. If the team is offshore, ask when they are actually online. Account management during AEST business hours is the minimum.
- Reporting tied to enquiries and revenue, not reach.
- A 30-day notice period after an initial term.
Local agency or international team?
A Sydney or Melbourne agency gives you in-person meetings and CBD overheads. Agencies in Brisbane, Perth, Adelaide, Newcastle, Geelong and the Gold Coast are often equally capable at lower cost. An international team can work well for Australian clients on the conditions above: AEST coverage, Australian-English creative (it is a "ute", not a "pickup"), demonstrated Privacy Act, Spam Act and ACL practice, and Australian references. Ask for all four before signing.
Whoever you shortlist, give each the same brief and ask for a 90-day plan rather than a deck. The plan will show you who looked at your Search Console and who knows the EOFY calendar. If ours is the plan you understand, book a call.
Frequently asked questions
Which platforms matter most in Australia?
Google for search and Meta for social carry most of the spend and most of the results for typical businesses. TikTok matters for younger consumer audiences and LinkedIn for B2B.
Do I need consent to send marketing emails in Australia?
Yes, under the Spam Act: express consent, or consent inferred from an existing business relationship, plus accurate sender details and a working unsubscribe.
When should EOFY campaigns go live?
Budgets and creative should be ready by early May; the buying window runs through June and peaks in the last two weeks.
Is an offshore agency a risk for an Australian business?
Only if nobody senior who understands the Australian market owns your account, or the team is offline during your business hours. Ask for AEST coverage and Australian references.
How local does local SEO need to be?
Suburb-level for service businesses in the metros. Build pages for the suburbs that matter to revenue, not for every suburb on the map.
